Privacy Policy
HIMO may collect information that a client chooses to provide, such as name, email address, project description, budget range, design preferences, reference links, uploaded files, project messages, and project status history. Information should be collected only for purposes that are explained to the client and are reasonably necessary to discuss, quote, deliver, secure, or support a requested project.
How information may be used
- Understand project requirements and prepare a project brief or quotation.
- Contact the client about their submission, quotation, delivery, or project status.
- Manage project work, prevent misuse, maintain security, and keep appropriate business records.
- Use relevant AI, hosting, database, email, or file-storage providers to support the service, where disclosed and configured appropriately.
AI and third-party services
Information submitted to an AI service or another provider may be processed by that provider under its own terms and privacy practices. HIMO should select providers carefully, avoid sending unnecessary personal or confidential information, and disclose the providers and processing arrangements actually used. Clients should not upload passwords, payment-card details, government identification, or other highly sensitive information unless HIMO has specifically established a safe and necessary process for it.
Storage, security, and retention
HIMO should use reasonable safeguards, limit access to authorized people, and retain personal information only as long as needed for the stated purpose or applicable legal and business requirements. No internet service can promise absolute security. The final live policy must state the actual storage locations, retention periods, contact for privacy requests, and procedures for access, correction, deletion, or other applicable rights.
Email and project tracking
When a client provides an email address for a project, HIMO may use it for submission confirmations, quotations, necessary project communications, and status notifications. Project details must be protected with suitable access controls; a project reference number alone should not expose private information. Marketing messages, if ever sent, should be handled separately and lawfully.
HIMO intends to serve clients in the Philippines. Personal-data handling must be aligned with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and applicable National Privacy Commission issuances. Before launch, HIMO must identify the responsible business/privacy contact, state the actual purposes and lawful basis for processing, identify relevant recipients/service providers, set practical retention periods, and provide a channel for privacy requests. Do not publish a claim of compliance until the actual practices have been checked.
Terms of Service
Service area: HIMO Digital currently intends to serve clients in the Philippines only. Project proposals and transactions are subject to applicable Philippine laws and regulations. HIMO should display its actual business name and contact details before accepting paid projects.
By using HIMO's website or submitting a project request, you agree to use the service lawfully and to provide information you are entitled to share. Submitting an idea is a request for review; it does not mean HIMO has accepted the project, agreed to a price, or promised a delivery date.
Project acceptance
HIMO reviews each request for scope, feasibility, resources, security, budget, and operating costs. HIMO may ask follow-up questions, propose a smaller scope, suggest an alternative, or decline a project it cannot reasonably deliver. Work begins only after the client receives and accepts a written quotation or proposal and any agreed initial payment requirements have been met.
Client responsibilities
Clients should provide accurate requirements, timely feedback, and materials they have the right to use. Clients are responsible for reviewing the approved scope, checking business content and legal notices relevant to their own business, and obtaining permissions for supplied images, logos, text, data, and other materials.
Changes and cancellation
Requests outside the approved scope may require a revised quotation and schedule. Cancellation, refunds, and payment obligations will be handled under the project-specific agreement and applicable law; HIMO will not rely on this general page to remove any non-waivable consumer rights. The final terms must state actual payment milestones and cancellation handling before clients commit.
Third-party components
A project may use open-source software, libraries, hosting providers, APIs, fonts, or other third-party services. Those components may have separate license terms, usage limits, or charges. HIMO will identify material dependencies and relevant restrictions as part of the agreed delivery where applicable.
AI Disclaimer
HIMO may use AI to help clarify a client's idea, ask follow-up questions, summarize requirements, analyze supplied references, identify unresolved decisions, and suggest practical implementation options. AI output can be incomplete, inaccurate, or unsuitable for a particular project.
- AI-generated summaries and recommendations should be reviewed by the client before submission and by HIMO before a project is accepted.
- AI estimates are preliminary only. The final scope, price, timeline, and acceptance decision require HIMO's review and approval.
- AI may suggest features or approaches that are not feasible, secure, affordable, or supported by the chosen infrastructure. These must be assessed before they are promised.
- AI-generated content and code must be checked and tested. HIMO will not represent untested functionality as verified.
Clients should not treat AI output as legal, financial, security, or other professional advice. HIMO will explain material limitations discovered during project review.
Pricing, Payment & Refund Policy
HIMO's intended model is a one-time development fee for the agreed project scope, rather than a mandatory monthly development subscription. The amount, payment schedule, included deliverables, revisions, delivery expectations, hosting period (if any), and external charges must be stated in a project-specific quotation before work begins.
Estimates and final price
AI may suggest a package, cost-saving approach, or preliminary price range. This is not a binding quote. HIMO reviews the requirements and approves the final price. A client's budget is used to explore suitable alternatives, not automatically treated as the price of the requested work.
External costs
Domain registration, paid hosting, paid APIs, AI usage, payment processing, SMS, email, and other third-party services may carry separate charges. HIMO should disclose known costs and who will pay them before the client approves the project.
Refunds and cancellations
Refund eligibility depends on the agreed contract, work completed, payment milestones, and applicable law. HIMO must provide clear project-specific cancellation and refund terms before accepting payment. Nothing in this policy is intended to exclude consumer rights or remedies that cannot legally be excluded.
Hosting & Domain Policy
HIMO may offer free hosting or a provider subdomain as a cost-saving option when it is technically suitable. Free services can have usage limits, provider branding, availability restrictions, and terms that may change. HIMO does not promise lifetime free hosting or uninterrupted availability.
Custom domains
If a client wants a custom domain, the intended arrangement is for the client to purchase and own it through their own registrar account and pay the registrar directly for registration and renewal. Domain fees are often annual, but billing terms depend on the registrar. HIMO may help connect the domain to the website if that work is included in the quotation.
Hosting and renewal
The quotation must state whether hosting is included, for how long, which account controls it, what usage limits apply, and what happens when the included period ends. Paid hosting or other recurring third-party services are the client's responsibility only where that responsibility has been disclosed and agreed. Free hosting and a custom domain can sometimes be combined; the best arrangement depends on the project.
Transfers and provider changes
HIMO will describe practical transfer options for compatible deliverables. Transfers may require technical work or incur a separately agreed fee. Provider changes, account eligibility, and technical compatibility can affect whether a transfer is possible.
Project Delivery & Ownership Policy
After the client meets the agreed payment terms, HIMO will provide the deliverables specifically listed in the accepted quotation, which may include a deployed website or application, agreed source files, assets, documentation, and deployment instructions.
Customer ownership
HIMO's intended approach is that clients own the agreed project-specific deliverables, subject to third-party software licenses, pre-existing tools, stock assets, open-source licenses, and any exclusions clearly identified in the proposal. Ownership does not automatically transfer third-party intellectual property or services that are licensed rather than sold.
Testing and acceptance
The quotation should identify the key features and acceptance criteria. Clients should review the delivered work and report issues within any agreed review period. HIMO should test the agreed functionality before delivery, while explaining any known limitations or items not included in the scope.
Client materials and credentials
Clients remain responsible for the rights and accuracy of materials they supply. Credentials should be shared using a secure method, not included in public project briefs or ordinary notification emails. HIMO should hand over or transfer agreed accounts and access securely and remove access that is no longer needed.
Support & Maintenance Policy
One-time development covers only the work and support expressly included in the accepted quotation. The quotation should specify any post-delivery review period, included revisions, defect-reporting process, and support limits.
Defects versus new work
A reproducible defect in an agreed feature may be handled under the project's stated defect-support terms. A new feature, design change, third-party provider change, new browser or platform requirement, or modification to client-edited code may require a separate quotation.
Ongoing maintenance
Maintenance, hosting renewal, backups, monitoring, security updates, data recovery, and third-party subscriptions are not automatically included for life. Where a project requires ongoing services, HIMO will explain the available arrangements and costs in advance. Clients should keep independent backups of important business data where appropriate.
Reasonable limits
HIMO will make reasonable efforts to deliver work within the agreed scope, but cannot guarantee uninterrupted third-party services or that software will never encounter defects. This does not remove any responsibilities or legal obligations that apply to HIMO's work.
Philippine legal framework
These policies are intended for a business serving clients in the Philippines. Depending on the actual service and transaction, relevant rules may include the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules, the Internet Transactions Act of 2023 (Republic Act No. 11967) and its implementing rules where applicable, the Consumer Act of the Philippines (Republic Act No. 7394), the Electronic Commerce Act (Republic Act No. 8792), and applicable intellectual-property laws.
This list is informational, not a legal opinion or a claim that every law applies to every project. HIMO should have the final terms reviewed against its business structure, actual practices, and service offerings before launch.
